Substance Use Disorder Records (42 CFR Part 2 Protections)
We maintain the confidentiality of substance use disorder (SUD) records in accordance with federal law, including 42 CFR Part 2 and the Health Insurance Portability and Accountability Act (HIPAA). Records related to substance use treatment may be used and disclosed for purposes of treatment, payment, and healthcare operations with your written consent.
You may provide a single written consent for these purposes, which may allow your information to be shared with other healthcare providers, insurance companies, and healthcare operations as permitted by law.
However, federal law provides additional protections for SUD records. These records generally may not be used or disclosed in legal proceedings without your specific written consent or a court order. Once your information is disclosed with your consent, it may be subject to redisclosure by the recipient in accordance with HIPAA regulations.
You have the right to revoke your consent at any time, in writing, except to the extent that action has already been taken in reliance on your consent.
